保定市人民政府作為主辦單位，保定國家高新技術產業開發區管理委員會、保定市自然資源和規劃局作為承辦單位，保定國家高新技術產業開發區管理委員會東西區管理局作為征集人現舉辦“保定國際醫療基地城市設計國際方案征集”活動。本次方案征集活動將公開邀請具有相關規劃設計經驗的設計機構前來申請應征，提交資格預審申請文件（以下簡稱“申請文件”）。通過資格預審選取4個應征人參加征集活動，并提交應征設計成果。
Baoding Municipal People's Government as the Sponsor,together with the Baoding National Hi-Tech Industrial Development Zone Administration Committee and the Baoding Natural Resources and Planning Bureau as the Organizers,and the East-West Division of Baoding National Hi-Tech Industrial Development Zone Administration Committee as the Solicitor,is currently holding the"International Solicitation of Urban Design Proposals for Baoding International Medical Base.”Design entities worldwide with related planning and design experience are publicly invited to participate and submit the Application Documents for Prequalification(hereinafter referred to as“Application Documents”).The Sponsor will select four final applicants as Participants for solicitation of proposals and for them to further submit their design proposals for response.

1.1 Project name:International Solicitation of Urban Design Proposals for Baoding International Medical Base
1.2項目位置：保定國際醫療基地位于保定市主城區東部12公里的高鐵片區，交通區位優勢明顯。依托保定東站，以及京港澳高速、七一路、東三環、東風東路、天威東路的交通主骨架，與京津、雄安、石家莊等京津冀城市圈中重要節點城市建立便捷暢通的交通渠道，距北京高鐵40分鐘，緊鄰雄安新區，全面融入京津冀“一小時交通圈”和“半小時生活圈”。
1.2 Project location:Baoding International Medical Base is situated in a high-speed rail zone approximately 12 kilometers away to the eastern part of Baoding City's main urban area,with exceptional transportation advantages.The medical base takes advantage of its proximity to Baoding East Railway Station and key transportation routes,including the Beijing-Hong Kong-Macau Expressway,Qiyi Road,East Third Ring Road,East Dongfeng Road,and East Tianwei Road.This strategic location enables convenient and efficient transportation connections with important cities in the Beijing-Tianjin-Hebei metropolitan area,such as Beijing,Tianjin,Xiongan,and Shijiazhuang.With a mere 40-minute high-speed train ride from Beijing and its close proximity to Xiongan New Area,the medical base seamlessly integrates into the"one-hour transportation circle"and"30-minute living circle"of the Beijing-Tianjin-Hebei region.
1.3項目規模：本次征集范圍包含兩個空間層次，一是總體城市設計范圍，包括國際醫療基地起步區西區與起步區東區、保定東站站前區、國際醫療基地擴展區及周邊的戰略留白空間，面積約30平方公里。二是重點片區詳細城市設計范圍，包括起步區東區、保定東站站前區、國際醫療基地擴展區核心區域，面積不低于10平方公里（含不少于2平方公里的核心節點兩處，具體范圍設計單位自定）。
1.3 Project scale:The scope of this solicitation includes two spatial levels.Firstly,the overall urban design scope,which includes the western and eastern areas of the Baoding International Medical Base Starting Area,the area in front of the Baoding East Railway Station,the expansion zone of the International Medical Base,and the surrounding strategic vacant spaces,covering an approximate area of 30 square kilometers.Secondly,the detailed urban design scope of key areas,encompassing the eastern area of the Baoding International Medical Base Starting Area,the area in front of Baoding East Railway Station,and the core area of the expansion zone of the International Medical Base.The total area should be no less than 10 square kilometers(including two core nodes,each covering at least 2 square kilometers;the exact delineation of the scope will be determined by the design entities).

本次城市設計國際方案征集的設計內容分為基礎研究、總體城市設計、重點片區詳細城市設計和實施計劃四項內容。

包括：總體結構與功能布局、整體空間形態與風貌特色引導、生態空間設計、開放空間設計、綜合交通規劃、村莊布局與發展建議等。
It encompasses various aspects,including the overall structure and functional layout,guidance for the overall spatial form and distinctive features,ecological space design,open space design,comprehensive transportation planning,village layout,and development recommendations,among others.
1.4.3重點片區詳細城市設計
1.4.3 Detailed urban design of key areas
包括：對重點片區的空間形態、公共空間、道路交通系統及建筑設計等提出更為詳細的控制及引導建議。
It encompasses the provision of comprehensive and specific control and guidance recommendations for the spatial form,public spaces,road transportation systems,and architectural design in key areas.

包括：與法定規劃銜接建議、資金平衡與分期建議、行動計劃建議等。

4.應征申請人的資格
4.Eligibility and Qualifications of Applicants
4.1應征申請人（以下簡稱“申請人”）應為合法注冊的法人實體或由合法注冊的法人實體組成的項目聯合體。
4.1 Any prequalification Applicant(hereinafter referred to as"Applicant")shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws.
4.2應征申請人應具有承擔本征集項目規劃設計和相關產業研究與策劃的專業技術能力。
4.2 Applicants should possess the professional technical ability to undertake the planning and design and relevant industrial research and planning of this solicitation project.
4.2.1城鄉規劃或建筑設計的相應資質或資格要求如下：
4.2.1 The requirements for the corresponding eligibility or qualifications to undertake the urban and rural planning or architectural design are as follows:
4.2.1.1中華人民共和國境內的設計機構應具有政府有關行政主管部門核發的城鄉規劃編制甲級資質或建筑行業（建筑工程）設計甲級及以上資質；
4.2.1.1 Design entities within the People's Republic of China should have the following qualification issued by the relevant government administrative department:a qualification certificate of Grade A for urban and rural planning or a qualification certificate of Grade A for architectural design(architectural engineering)or above;
4.2.1.2中華人民共和國境外的設計機構應依其所屬國或所屬地區的管理規定具有城市規劃或建筑設計的執業許可或經營許可。
4.2.1.2 Design entities outside the People's Republic of China should have a practice license or business license for urban planning or architectural design in accordance with the national or local administrative regulations.
4.2.2相關產業研究與策劃專業技術能力要求如下：
4.2.2 The requirements for professional technical ability of relevant industrial research and planning are as follows:
應征申請人應具有相關產業研究與策劃的經驗和業績，并能提供與此相關的證明資料。
Applicants shall have corresponding experience and achievements in relevant industrial research and planning,and be able to provide relevant supporting materials.
4.3中華人民共和國境外的應征申請人須與中華人民共和國境內的申請人組成聯合體應征。
4.3 Any applicant outside the People's Republic of China shall form a Consortium with an applicant inside the People's Republic of China before participating in the solicitation.
4.4香港、澳門特別行政區和臺灣地區的規劃設計機構的資格要求參照境外設計機構資格要求的規定。
4.4 The qualifications for planning and design entities from Hong Kong and Macau Special Administrative Regions as well as Taiwan shall refer to the requirements of qualifications for design entities outside the People’s Republic of China.
4.5本項目接受聯合體應征。
4.5 This Project accepts applications from Consortia.
4.5.1聯合體的各成員應共同簽署一份聯合體協議。
4.5.1 Partners of a Consortium shall jointly sign a consortium agreement.
4.5.2組成項目聯合體的各成員單位不得再以自己的名義單獨申請資格預審，也不得同時加入本項目其它聯合體申請資格預審。
4.5.2 Any partner of the Consortium shall neither individually apply for the prequalification in its own name,nor concurrently apply for the prequalification as a partner of another Consortium.
4.6除聯合體內部的成員外，參加征集的應征人之間不應存在關聯關系。
4.6 Except for partners of a Consortium,the Participants in the solicitation shall not constitute or bear any affiliations.

The Prequalification Documents for this Project can be downloaded from the website of Beijing Science Park Auction&Tender Co.,Ltd.
有意向參加應征的申請人需先在北京科技園拍賣招標有限公司網站（www.bkpmzb.com）下載資格預審文件領取登記表，填寫完成后以Word版本發送電子郵件至征集指定郵箱kjysanbu 163.com或遞交至征集組織機構，征集組織機構收到登記表后，再將資格預審文件的下載密碼發送給申請人。
Applicants who intend to participate in the solicitation for design proposals must first download the registration form from the website of Beijing Science Park Auction&Tender Co.,Ltd.(www.bkpmzb.com).After completing the registration form,Applicants should email the Word version to kjysanbu 163.com or submit it to the Organizer of Solicitation.After receiving the registration form,the Organizer of Solicitation will send the download password of the Prequalification Documents to the Applicants.
獲取資格預審文件的時間為2023年9月15日至2023年9月28日12:00（中國北京時間，下同）。北京科技園拍賣招標有限公司網站將于2023年9月15日開通。
The date for obtaining Prequalification Documents is from September 15,2023 to 12:00 on September 28,2023(Beijing Time,the same below).The website of Beijing Science Park Auction&Tender Co.,Ltd.will be accessible on September 15,2023.
6.申請文件的遞交
6.Submission of Application Documents
申請文件遞交的截止時間為2023年10月8日中午12時00分，申請人應在遞交截止時間之前將申請文件遞交至征集組織機構。主辦單位、承辦單位、征集人和征集組織機構將拒絕接收逾期送達的申請文件。
The deadline for submission of Application Documents is 12:00 noon on October 8,2023.Applicants shall submit such documents to the Organizer of Solicitation before the deadline.The Sponsor,the Organizers,the Solicitor,and the Organizer of Solicitation will reject any application documents that arrive after the specified deadline.

This announcement will be published on the China Tendering and Bidding Public Service Platform(www.cebpubservice.com),China Government Procurement Network(www.ccgp.gov.cn),and the website of Beijing Science Park Auction&Tender Co.,Ltd.(www.bkpmzb.com)at the same time.The amendment and supplement of the announcement shall be subject to the contents released via the websites aforementioned.

8.1知識產權
8.1 Intellectual Property Rights(IPRs)
8.1.1本次方案征集中接收的所有有效的應征文件（包括A3版面設計文冊、A0標準輕質展板、模型、電子文件和應征設計方案著作權聲明等）均不退回。
8.1.1 All valid response proposals received in this solicitation(including the A3-sized design book,A0 standard lightweight exhibition panels,models,electronic documents,and the Copyright Statement of Design Proposals)will not be returned.
8.1.2應征設計文件和設計成果的知識產權由主辦單位/承辦單位/征集人與應征人共同享有：
8.1.2 The intellectual property rights(IPRs)of the Design Proposals and design results shall be owned in common by the Sponsor/Organizers/Solicitor and the Participants.
8.1.2.1應征人對其應征設計文件享有署名權，在征得主辦單位/承辦單位/征集人書面同意后可通過傳播媒介、專業雜志、書刊或其他形式評價、展示其應征設計文件的相關內容。除應征人的設計標準、設計導則和繪圖元素以外，應征人不得將應征設計文件及設計成果用于其他的設計項目。
8.1.2.1 Participants hold the right of authorship for their Design Proposals and can comment on and display such Design Proposals in the forms of media communications,trade magazines,publications among others after granted with the Sponsor’s/Organizers’/Solicitor’s consent in writing.The Participants shall not use the Design Proposal and design results on other projects,except the Participant’s design standards,design guidelines,and drawing elements.
8.1.2.2主辦單位/承辦單位/征集人有權在本項目的規劃設計中使用應征人提交的規劃設計成果，主辦單位/承辦單位/征集人在項目的規劃設計中或在規劃設計方案調整綜合時可以全部或部分使用應征規劃設計成果的內容，也可以對其進行修改。主辦單位/承辦單位/征集人不得將應征設計文件及設計成果用于本項目以外的其他項目。
8.1.2.2 The Sponsor/Organizers/Solicitor have the right to use the planning and design results submitted by the Participants in the planning and design of this Project.The Sponsor/Organizers/Solicitor have the right to use the Design Proposals in whole or in part in the planning and design of this Project or the adjustment and integration of the planning and design proposals,and also have the right to modify them.The Sponsor/Organizers/Solicitor shall not use the Design Proposals and design results for a purpose other than this Project.
8.1.2.3主辦單位/承辦單位/征集人可以對所有應征設計文件及設計成果印刷、出版和展覽，并可通過傳播媒介、專業雜志、書刊或其他形式評價、展示、宣傳應征設計文件及設計成果，但應注明設計機構的名稱。
8.1.2.3 The Sponsor/Organizers/Solicitor can print,publish and exhibit all the Design Proposals and design results,or comment on,display and publicize the Design Proposals and design results via media communications,trade magazines,publications or by other means,while indicating the names of design entities for such design.
8.1.2.4應征建筑設計方案（如果有）的著作權歸屬于應征人，但景觀小品及其建構筑物除外。
8.1.2.4 The copyright of architectural design proposals(if any)shall belong to the Participants,except for landscape embellishments and their structures.
8.1.3應征人應保證提交的應征設計文件及設計成果在中華人民共和國境內或境外沒有且不會侵犯任何其他人的知識產權（包括但不限于著作權、專利權）或專有技術或商業秘密。應征人應保證，如果其應征設計文件使用或包含任何其他人的知識產權或專有技術或商業秘密，應征人應已經獲得權利人的合法、有效、充分的授權。應征人因侵犯他人知識產權或專有技術或商業秘密所引起的全部賠償責任應由應征人承擔。
8.1.3 Participants shall ensure that all the submitted Design Proposals and design results have not infringed upon and will not infringe upon IPRs(including but not limited to copyright and patent right)or proprietary technologies or trade secrets of others within or outside the People’s Republic of China.The Participants shall guarantee that if their Design Proposals use or include IPRs or proprietary technologies or trade secrets of others,the Participants shall have already obtained legitimate,valid and sufficient authorization from the right holders.The Participants shall take all liabilities for any compensations arising from infringement upon IPRs or proprietary technologies or trade secrets of others.
8.2應征設計補償金
8.2 Compensations for Designs Proposals
征集人將向按照征集文件的要求在規定的時間內提交了有效應征文件的應征人支付應征設計補償金，金額為人民幣140萬元（含稅）。當應征人出現下列情況時，征集人將不予支付補償金：
The Solicitor will pay Compensations for Design Proposals in the amount of RMB 1.4 million(including tax)for any Participant that has submitted valid response documents within specified timeframe as required in the Solicitation Documents.The Solicitor will not pay any compensation when Participants are under any of the following circumstances:
（1）應征人未能在征集文件規定的時間內提交應征文件；
（1）Participants fail to submit their response proposals within the time specified in the Solicitation Documents;
（2）應征人提交的應征文件被應征設計方案評審委員會認定為未對征集文件的要求作出實質性響應；
（2）The response proposals submitted by Participants are judged,upon the Jury review,as not substantially responding to the requirements of the Solicitation Documents;
（3）應征人被取消應征資格。
（3）Participants are disqualified.
8.3獎項的設置
8.3 Awards settings
本次方案征集擬選取2個優勝設計方案，其應征設計方案被評選為優勝設計方案的應征人需按照主辦單位、承辦單位和征集人的要求進行方案優化，優化費用為50萬元（含稅）。
In this proposal solicitation,it is planned to select two winning Design Proposals.The Participants whose Design Proposals are selected as the winning design proposals are required to optimize their proposals according to the requirements of the Sponsor,Organizers,and Solicitor.The optimization fee is RMB 500,000(including tax).
8.4補償金和優化費用的支付
8.4 Payment of compensations and optimization fee
應征人的補償金及優化費用以人民幣支付。如境外應征人在中華人民共和國境內沒有常設機構，也沒有可以接受人民幣的中華人民共和國境內賬戶，可委托中華人民共和國境內的收款人全權處理收付款事宜，并為其代繳各種中華人民共和國境內稅費，由此而產生的相關費用由應征人自行承擔。
Payment of compensations and optimization fee will be made in RMB.In the case where an overseas Participant has neither permanent institution nor domestic account within the People’s Republic of China to accept RMB,a domestic payee within the People’s Republic of China may be authorized to handle payment matters in full powers and be entrusted to withhold/pay various taxes within the People’s Republic of China.The relevant expenses incurred shall be borne by the Participant.
8.5征集后續工作
8.5 Follow-up work for the solicitation
本項目不依據方案征集的結果授予設計或咨詢合同，其項目的方案綜合、以及后續的規劃及城市設計編制將按照國家相關的法律法規選擇規劃設計單位。
This Project will not award design or consulting contracts solely based on the results of the solicitation.The selection of planning and design entities for the Project's proposal integration,as well as the subsequent planning and urban design preparations,will adhere to the relevant national laws and regulations.
8.6適用法律
8.6 Governing laws
本次征集活動本身及與本次活動相關的文件所適用的法律和法規僅為中華人民共和國的法律和法規。
The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
8.7語言
8.7 Languages
資格預審文件以及與資格預審文件相關的補充文件和澄清文件均使用中文和英文書寫。申請文件應使用中文書寫，申請人隨申請文件提供的證明文件和印刷品可以使用另一種語言，但應附中文譯本。在中文與其他語言的意思表達不一致時，以中文為準。
The language used in the Prequalification Documents and supplement documents and clarification documents thereto shall be Chinese and English.The Application Documents shall be drafted in Chinese.Another language can be used for the proof documents and printed materials that Applicants provide along with the Application Documents,but the version with Chinese translation shall be attached thereto.In the case of inconsistent expressions in both Chinese and another language,the Chinese version shall prevail.

本次征集活動的最終解釋權歸主辦單位、承辦單位和征集人。

4.應征申請人的資格
4.Eligibility and Qualifications of Applicants
4.1應征申請人（以下簡稱“申請人”）應為合法注冊的法人實體或由合法注冊的法人實體組成的項目聯合體。
4.1 Any prequalification Applicant(hereinafter referred to as"Applicant")shall be a legal entity that has been legally incorporated in accordance with laws or a project consortium composed of legal entities that have been legally incorporated in accordance with laws.
4.2應征申請人應具有承擔本征集項目規劃設計和相關產業研究與策劃的專業技術能力。
4.2 Applicants should possess the professional technical ability to undertake the planning and design and relevant industrial research and planning of this solicitation project.
4.2.1城鄉規劃或建筑設計的相應資質或資格要求如下：
4.2.1 The requirements for the corresponding eligibility or qualifications to undertake the urban and rural planning or architectural design are as follows:
4.2.1.1中華人民共和國境內的設計機構應具有政府有關行政主管部門核發的城鄉規劃編制甲級資質或建筑行業（建筑工程）設計甲級及以上資質；
4.2.1.1 Design entities within the People's Republic of China should have the following qualification issued by the relevant government administrative department:a qualification certificate of Grade A for urban and rural planning or a qualification certificate of Grade A for architectural design(architectural engineering)or above;
4.2.1.2中華人民共和國境外的設計機構應依其所屬國或所屬地區的管理規定具有城市規劃或建筑設計的執業許可或經營許可。
4.2.1.2 Design entities outside the People's Republic of China should have a practice license or business license for urban planning or architectural design in accordance with the national or local administrative regulations.
4.2.2相關產業研究與策劃專業技術能力要求如下：

應征申請人應具有相關產業研究與策劃的經驗和業績，并能提供與此相關的證明資料。
Applicants shall have corresponding experience and achievements in relevant industrial research and planning,and be able to provide relevant supporting materials.
4.3中華人民共和國境外的應征申請人須與中華人民共和國境內的申請人組成聯合體應征。
4.3 Any applicant outside the People's Republic of China shall form a Consortium with an applicant inside the People's Republic of China before participating in the solicitation.
4.4香港、澳門特別行政區和臺灣地區的規劃設計機構的資格要求參照境外設計機構資格要求的規定。
4.4 The qualifications for planning and design entities from Hong Kong and Macau Special Administrative Regions as well as Taiwan shall refer to the requirements of qualifications for design entities outside the People’s Republic of China.
4.5本項目接受聯合體應征。
4.5 This Project accepts applications from Consortia.
4.5.1聯合體的各成員應共同簽署一份聯合體協議。
4.5.1 Partners of a Consortium shall jointly sign a consortium agreement.
4.5.2組成項目聯合體的各成員單位不得再以自己的名義單獨申請資格預審，也不得同時加入本項目其它聯合體申請資格預審。
4.5.2 Any partner of the Consortium shall neither individually apply for the prequalification in its own name,nor concurrently apply for the prequalification as a partner of another Consortium.
4.6除聯合體內部的成員外，參加征集的應征人之間不應存在關聯關系。
4.6 Except for partners of a Consortium,the Participants in the solicitation shall not constitute or bear any affiliations.

The Prequalification Documents for this Project can be downloaded from the website of Beijing Science Park Auction&Tender Co.,Ltd.
有意向參加應征的申請人需先在北京科技園拍賣招標有限公司網站（www.bkpmzb.com）下載資格預審文件領取登記表，填寫完成后以Word版本發送電子郵件至征集指定郵箱kjysanbu 163.com或遞交至征集組織機構，征集組織機構收到登記表后，再將資格預審文件的下載密碼發送給申請人。
Applicants who intend to participate in the solicitation for design proposals must first download the registration form from the website of Beijing Science Park Auction&Tender Co.,Ltd.(www.bkpmzb.com).After completing the registration form,Applicants should email the Word version to kjysanbu 163.com or submit it to the Organizer of Solicitation.After receiving the registration form,the Organizer of Solicitation will send the download password of the Prequalification Documents to the Applicants.
獲取資格預審文件的時間為2023年9月15日至2023年9月28日12:00（中國北京時間，下同）。北京科技園拍賣招標有限公司網站將于2023年9月15日開通。
The date for obtaining Prequalification Documents is from September 15,2023 to 12:00 on September 28,2023(Beijing Time,the same below).The website of Beijing Science Park Auction&Tender Co.,Ltd.will be accessible on September 15,2023.
6.申請文件的遞交
6.Submission of Application Documents
申請文件遞交的截止時間為2023年10月8日中午12時00分，申請人應在遞交截止時間之前將申請文件遞交至征集組織機構。主辦單位、承辦單位、征集人和征集組織機構將拒絕接收逾期送達的申請文件。
The deadline for submission of Application Documents is 12:00 noon on October 8,2023.Applicants shall submit such documents to the Organizer of Solicitation before the deadline.The Sponsor,the Organizers,the Solicitor,and the Organizer of Solicitation will reject any application documents that arrive after the specified deadline.

7.Media Releasing Announcement on Prequalification
本公告在中國招標投標公共服務平臺（www.cebpubservice.com）、中國政府采購網（www.ccgp.gov.cn）、北京科技園拍賣招標有限公司網站（www.bkpmzb.com）同時發布。本公告的修改、補充以在以上網站發布的內容為準。
This announcement will be published on the China Tendering and Bidding Public Service Platform(www.cebpubservice.com),China Government Procurement Network(www.ccgp.gov.cn),and the website of Beijing Science Park Auction&Tender Co.,Ltd.(www.bkpmzb.com)at the same time.The amendment and supplement of the announcement shall be subject to the contents released via the websites aforementioned.

8.1知識產權
8.1 Intellectual Property Rights(IPRs)
8.1.1本次方案征集中接收的所有有效的應征文件（包括A3版面設計文冊、A0標準輕質展板、模型、電子文件和應征設計方案著作權聲明等）均不退回。
8.1.1 All valid response proposals received in this solicitation(including the A3-sized design book,A0 standard lightweight exhibition panels,models,electronic documents,and the Copyright Statement of Design Proposals)will not be returned.
8.1.2應征設計文件和設計成果的知識產權由主辦單位/承辦單位/征集人與應征人共同享有：
8.1.2 The intellectual property rights(IPRs)of the Design Proposals and design results shall be owned in common by the Sponsor/Organizers/Solicitor and the Participants.
8.1.2.1應征人對其應征設計文件享有署名權，在征得主辦單位/承辦單位/征集人書面同意后可通過傳播媒介、專業雜志、書刊或其他形式評價、展示其應征設計文件的相關內容。除應征人的設計標準、設計導則和繪圖元素以外，應征人不得將應征設計文件及設計成果用于其他的設計項目。
8.1.2.1 Participants hold the right of authorship for their Design Proposals and can comment on and display such Design Proposals in the forms of media communications,trade magazines,publications among others after granted with the Sponsor’s/Organizers’/Solicitor’s consent in writing.The Participants shall not use the Design Proposal and design results on other projects,except the Participant’s design standards,design guidelines,and drawing elements.
8.1.2.2主辦單位/承辦單位/征集人有權在本項目的規劃設計中使用應征人提交的規劃設計成果，主辦單位/承辦單位/征集人在項目的規劃設計中或在規劃設計方案調整綜合時可以全部或部分使用應征規劃設計成果的內容，也可以對其進行修改。主辦單位/承辦單位/征集人不得將應征設計文件及設計成果用于本項目以外的其他項目。
8.1.2.2 The Sponsor/Organizers/Solicitor have the right to use the planning and design results submitted by the Participants in the planning and design of this Project.The Sponsor/Organizers/Solicitor have the right to use the Design Proposals in whole or in part in the planning and design of this Project or the adjustment and integration of the planning and design proposals,and also have the right to modify them.The Sponsor/Organizers/Solicitor shall not use the Design Proposals and design results for a purpose other than this Project.
8.1.2.3主辦單位/承辦單位/征集人可以對所有應征設計文件及設計成果印刷、出版和展覽，并可通過傳播媒介、專業雜志、書刊或其他形式評價、展示、宣傳應征設計文件及設計成果，但應注明設計機構的名稱。
8.1.2.3 The Sponsor/Organizers/Solicitor can print,publish and exhibit all the Design Proposals and design results,or comment on,display and publicize the Design Proposals and design results via media communications,trade magazines,publications or by other means,while indicating the names of design entities for such design.
8.1.2.4應征建筑設計方案（如果有）的著作權歸屬于應征人，但景觀小品及其建構筑物除外。
8.1.2.4 The copyright of architectural design proposals(if any)shall belong to the Participants,except for landscape embellishments and their structures.
8.1.3應征人應保證提交的應征設計文件及設計成果在中華人民共和國境內或境外沒有且不會侵犯任何其他人的知識產權（包括但不限于著作權、專利權）或專有技術或商業秘密。應征人應保證，如果其應征設計文件使用或包含任何其他人的知識產權或專有技術或商業秘密，應征人應已經獲得權利人的合法、有效、充分的授權。應征人因侵犯他人知識產權或專有技術或商業秘密所引起的全部賠償責任應由應征人承擔。
8.1.3 Participants shall ensure that all the submitted Design Proposals and design results have not infringed upon and will not infringe upon IPRs(including but not limited to copyright and patent right)or proprietary technologies or trade secrets of others within or outside the People’s Republic of China.The Participants shall guarantee that if their Design Proposals use or include IPRs or proprietary technologies or trade secrets of others,the Participants shall have already obtained legitimate,valid and sufficient authorization from the right holders.The Participants shall take all liabilities for any compensations arising from infringement upon IPRs or proprietary technologies or trade secrets of others.
8.2應征設計補償金
8.2 Compensations for Designs Proposals
征集人將向按照征集文件的要求在規定的時間內提交了有效應征文件的應征人支付應征設計補償金，金額為人民幣140萬元（含稅）。當應征人出現下列情況時，征集人將不予支付補償金：
The Solicitor will pay Compensations for Design Proposals in the amount of RMB 1.4 million(including tax)for any Participant that has submitted valid response documents within specified timeframe as required in the Solicitation Documents.The Solicitor will not pay any compensation when Participants are under any of the following circumstances:
（1）應征人未能在征集文件規定的時間內提交應征文件；
（1）Participants fail to submit their response proposals within the time specified in the Solicitation Documents;
（2）應征人提交的應征文件被應征設計方案評審委員會認定為未對征集文件的要求作出實質性響應；
（2）The response proposals submitted by Participants are judged,upon the Jury review,as not substantially responding to the requirements of the Solicitation Documents;
（3）應征人被取消應征資格。
（3）Participants are disqualified.
8.3獎項的設置
8.3 Awards settings
本次方案征集擬選取2個優勝設計方案，其應征設計方案被評選為優勝設計方案的應征人需按照主辦單位、承辦單位和征集人的要求進行方案優化，優化費用為50萬元（含稅）。
In this proposal solicitation,it is planned to select two winning Design Proposals.The Participants whose Design Proposals are selected as the winning design proposals are required to optimize their proposals according to the requirements of the Sponsor,Organizers,and Solicitor.The optimization fee is RMB 500,000(including tax).
8.4補償金和優化費用的支付
8.4 Payment of compensations and optimization fee
應征人的補償金及優化費用以人民幣支付。如境外應征人在中華人民共和國境內沒有常設機構，也沒有可以接受人民幣的中華人民共和國境內賬戶，可委托中華人民共和國境內的收款人全權處理收付款事宜，并為其代繳各種中華人民共和國境內稅費，由此而產生的相關費用由應征人自行承擔。
Payment of compensations and optimization fee will be made in RMB.In the case where an overseas Participant has neither permanent institution nor domestic account within the People’s Republic of China to accept RMB,a domestic payee within the People’s Republic of China may be authorized to handle payment matters in full powers and be entrusted to withhold/pay various taxes within the People’s Republic of China.The relevant expenses incurred shall be borne by the Participant.
8.5征集后續工作
8.5 Follow-up work for the solicitation
本項目不依據方案征集的結果授予設計或咨詢合同，其項目的方案綜合、以及后續的規劃及城市設計編制將按照國家相關的法律法規選擇規劃設計單位。
This Project will not award design or consulting contracts solely based on the results of the solicitation.The selection of planning and design entities for the Project's proposal integration,as well as the subsequent planning and urban design preparations,will adhere to the relevant national laws and regulations.
8.6適用法律
8.6 Governing laws
本次征集活動本身及與本次活動相關的文件所適用的法律和法規僅為中華人民共和國的法律和法規。
The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.
8.7語言
8.7 Languages
資格預審文件以及與資格預審文件相關的補充文件和澄清文件均使用中文和英文書寫。申請文件應使用中文書寫，申請人隨申請文件提供的證明文件和印刷品可以使用另一種語言，但應附中文譯本。在中文與其他語言的意思表達不一致時，以中文為準。
The language used in the Prequalification Documents and supplement documents and clarification documents thereto shall be Chinese and English.The Application Documents shall be drafted in Chinese.Another language can be used for the proof documents and printed materials that Applicants provide along with the Application Documents,but the version with Chinese translation shall be attached thereto.In the case of inconsistent expressions in both Chinese and another language,the Chinese version shall prevail.
8.8解釋權
8.8 Power of interpretation
本次征集活動的最終解釋權歸主辦單位、承辦單位和征集人。
The Sponsor,the Organizers,and the Solicitor reserve the power of final interpretation in view of the solicitation.
